1. About these Terms

Myers Health and Fitness Pty Ltd trades as Next Level Physiotherapy and Strength Studio in Varsity Lakes, Queensland. In these Terms, “we”, “us” and “our” refer to that business.

These Terms apply to the use of our website and to physiotherapy appointments booked with us. They do not set the terms for separate strength coaching or classes.

Our online booking page links to these Terms and highlights the cancellation policy. Online appointments are confirmed when the booking is completed. By completing an online booking, you agree to the applicable booking terms. If our staff books an appointment for you, we provide the cancellation policy in your confirmation email and intake form. Please contact us if you have any questions about fees or these Terms before attending.

2. Website information and AI assistant

Information on our website, including articles and educational material, is general information. It is not an assessment, diagnosis or personalised treatment advice. Our website assistant answers general questions about our services, appointments, pricing and location. It directs questions about an individual's symptoms or injury to a physiotherapy appointment rather than giving personalised advice. The website and its assistant are not for emergencies or urgent clinical concerns.

A physiotherapist will discuss your circumstances, proposed care and consent with you during a consultation. Using the website or its assistant does not itself establish a treating relationship.

3. Appointments

Please give us accurate information when booking and tell us if relevant details change. Online bookings are confirmed immediately. We reserve an appointment time for you and ask that you arrive on time.

If you arrive late, your appointment may still finish at its scheduled time. The fee for the booked appointment may still apply. If you cannot attend, please contact us using one of the methods in section 4.

4. Cancellations, rescheduling and non-attendance

Please give at least 48 clock hours' notice before the scheduled start of your appointment if you need to cancel or reschedule. This period includes weekends and public holidays. You can notify us by phone or text on 0449 984 896, or by email at info@nextlevelstrengthstudio.com. Notice is measured from when your message reaches the relevant phone or email account; you do not need to wait for a staff member to reply.

If you cancel or reschedule with less than 48 clock hours' notice, or do not attend, you may be charged a fee of up to 100% of the booked appointment fee. We consider the circumstances when deciding whether to charge or waive a fee, including emergencies and exceptional circumstances. Please tell us as soon as you can if something prevents you from attending.

For appointments under a third-party funding arrangement, any cancellation charge or claim is also subject to the applicable funding rules and any separate agreement. NDIS-funded clients have a separate service agreement; an NDIS cancellation claim will be made only where the current NDIS rules permit it. Whether a client may be personally charged an amount that a funder does not pay depends on the applicable agreement, what was disclosed to the client and the relevant rules. Contact us if you would like to understand the arrangements for your funding before booking.

5. Fees, rebates and payment

The fee for your appointment and any expected out-of-pocket cost will be explained before treatment. Payment is due at the appointment unless we have agreed to another arrangement. We may accept card payments and eligible third-party funding arrangements, subject to their requirements.

Medicare benefits, private health fund rebates, DVA, NDIS or WorkCover funding may be available for eligible services, depending on your circumstances and the applicable rules. A referral, plan or approval does not necessarily cover the full appointment fee. You are responsible for any amount properly payable by you that is not covered by an applicable benefit or funding arrangement. We can explain the expected fee before you book or attend.

If an account remains unpaid, we may discuss payment arrangements with you. Any decision about future non-urgent bookings will take account of the circumstances and our applicable obligations.

6. Treatment consent and privacy

Before and during treatment, your physiotherapist will discuss relevant assessment or treatment with you and seek your consent. You can ask questions or decline a proposed treatment. We will explain the practical effect on your care where appropriate. Signing an intake form or accepting these Terms does not replace consent for a particular assessment or treatment.

We collect and handle personal and health information as described in our Privacy Collection Notice and Privacy Policy. Any specific permission for a use such as marketing photographs or a particular report disclosure is addressed separately; these Terms do not provide blanket consent for those uses.

7. Treatment outcomes and your legal rights

Assessment and treatment are tailored to individual circumstances. Outcomes vary, and we cannot guarantee a particular recovery result or timeframe.

Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. General information on our website does not replace appropriate individual clinical assessment.

8. Website content and exercise programs

Our website text, images and other educational materials may be protected by intellectual property rights. Please do not copy, republish or commercially use them without our permission, except as permitted by law.

You may use an exercise program we provide to you for your own care and share it with another practitioner involved in your care. Please do not publish or commercially distribute our materials without permission.

9. Acceptable website use

Please do not attempt to interfere with our website, access information or systems without permission, submit malicious material, or misuse website content or communication tools. We may take reasonable steps to protect the website and its users.

10. Applicable law

These Terms are governed by the laws of Queensland, Australia, subject to any mandatory rights or protections that apply to you.
